LIVE PLAN REVIEW TERMS & CONDITIONS

Spatial Clarity is a service provided by Luminist Homes, Inc. By booking a Live Plan Review, submitting plans, attending a review session, or accepting review materials, you (“Client”) acknowledge and agree to the following Terms & Conditions.

  1. Scope of Service

Spatial Clarity provides educational design feedback, observations, and opinions based on experience in residential design and construction. The purpose of the review is to help clients better understand how a home may function, feel, and perform before construction begins.

Reviews may include discussion of floor plans, elevations, site plans, furniture layout, circulation, natural light, storage, sight lines, privacy, scale, functionality, and overall user experience.

  1. No Architectural, Engineering, or Licensed Professional Services

Spatial Clarity and Luminist Homes, Inc. do not provide architectural, engineering, structural, surveying, code compliance, permitting, or other licensed professional services through the Live Plan Review service.

A Spatial Clarity review is not a substitute for the services of a licensed architect, engineer, interior designer, contractor, or other qualified professional. Clients should continue to rely on their design and construction professionals for project-specific design, technical, engineering, code compliance, permitting, and construction decisions.

No statements, comments, sketches, markups, redlines, or recommendations provided during a review shall be construed as architectural, engineering, or other licensed professional advice.

  1. Conceptual Feedback Only

Any comments, sketches, redlines, markups, recommendations, observations, or suggestions provided during a review are conceptual in nature and intended solely as design feedback.

Materials provided by Spatial Clarity are not construction documents, permit documents, engineering documents, specifications, instructions for construction, or professional design services.

  1. Client Responsibility

The Client remains solely responsible for all decisions related to the design, engineering, permitting, budgeting, scheduling, construction, and execution of their project.

The Client is responsible for reviewing and verifying all recommendations with their architect, engineer, designer, contractor, consultants, and applicable authorities before implementation.

  1. No Code Compliance Review

Spatial Clarity does not perform code compliance reviews and makes no representation or warranty that any recommendation complies with applicable building codes, zoning regulations, accessibility requirements, HOA requirements, engineering requirements, permit requirements, or other governmental regulations.

  1. No Warranties or Guarantees

Reviews are provided for informational and educational purposes only.

Spatial Clarity makes no guarantees regarding project outcomes, construction costs, resale value, permit approval, functionality, aesthetics, marketability, or the success of any recommendation discussed during the review.

Any decisions made by the Client based on review feedback are made solely at the Client’s own discretion and risk.

  1. Limitation of Liability

To the fullest extent permitted by law, Luminist Homes, Inc., Spatial Clarity, and their owners, officers, employees, contractors, affiliates, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or economic damages arising from or related to:

• The review session
• Any comments, recommendations, or opinions provided
• Review recordings
• Markups, sketches, or redlines
• The Client’s reliance upon review feedback
• Design, permitting, engineering, or construction decisions made by the Client or third parties

In all circumstances, the maximum liability of Luminist Homes, Inc. and Spatial Clarity shall be limited to the amount paid by the Client for the review session.

  1. Indemnification

The Client agrees to defend, indemnify, and hold harmless Luminist Homes, Inc., Spatial Clarity, and their owners, officers, employees, contractors, affiliates, and representatives from and against any claims, damages, losses, liabilities, costs, expenses, or attorney fees arising out of:

• The Client’s use of review materials
• Implementation of recommendations
• Design or construction decisions
• The Client’s project or property
• Claims brought by third parties related to the project

  1. Intellectual Property

All review materials, recordings, sketches, redlines, markups, written feedback, reports, and related content remain the intellectual property of Luminist Homes, Inc.

Clients may use these materials for their personal project only and may not reproduce, publish, distribute, sell, sublicense, or commercially exploit them without prior written permission.

  1. Session Recordings

Review sessions may be recorded and provided to the Client for future reference.

Recordings are intended solely for the Client’s personal use and may not be publicly distributed, reproduced, republished, or sold without written permission from Luminist Homes, Inc.

  1. Refunds, Cancellations, and Rescheduling

Clients may reschedule a review session with at least twenty-four (24) hours notice.

Cancellations or rescheduling requests made less than twenty-four (24) hours before the scheduled session may be subject to forfeiture of all or part of the session fee.

No-shows are not eligible for refunds.

  1. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California.

Any dispute arising from these Terms & Conditions or the services provided by Spatial Clarity shall be subject to the exclusive jurisdiction of the courts located in California.

  1. Acceptance

By booking a Live Plan Review, checking an agreement box during booking, submitting plans, attending a review session, or accepting review materials, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions in their entirety.
